5. Custom License (Seller-Defined)

For sellers who need licensing terms beyond the four standard types

Sellers can create one or more custom licenses for any product. Each custom license has a seller-defined name, description, terms, includes, and restrictions. This is especially common for Software and Games products where sellers may offer tiered access such as "Personal", "Team", "Enterprise", or "Source Code" licenses at different price points.

How it works:

  • Sellers define the license name, what is included, and what is restricted
  • Multiple custom licenses can exist on the same product, each with its own pricing
  • Buyers see the full custom license terms on the product page before purchasing
  • The seller is responsible for clearly communicating and enforcing their custom license terms

Buyer responsibility:

When purchasing a product with a custom license, review the seller-provided terms carefully. Custom license terms are set entirely by the seller and may differ significantly from the standard license types listed above.

6. Product-Type-Specific Licensing

Certain product types support additional licensing flexibility:

  • Software and Games:Sellers can create multiple custom-named licenses (e.g., "Indie", "Studio", "Enterprise") with separate pricing, terms, and restrictions for each tier. Buyers choose the license tier that fits their use case at checkout.
  • All product types: Sellers can offer multiple license options on the same product (e.g., Standard and Commercial Redistribution side by side), each at a different price. Buyers select the license that matches their intended use.

Regardless of product type, all licenses on 3DIMLI prohibit the use of purchased assets for training AI or machine learning models unless the seller explicitly permits it in their custom license terms.

General Legal Terms

As-Is Disclaimer:

All digital assets are provided "as-is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability:

In no event shall the seller or 3dimli be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from the use or inability to use the asset.

Governing Law and Dispute Resolution:

These license terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA. Any disputes arising under or related to these terms shall be resolved through binding arbitration in Wilmington, Delaware.

Termination Clause:

Violation of these license terms automatically terminates the buyer's right to use the asset. Upon termination, the buyer must immediately cease using the asset and destroy all copies.

Notes for Sellers

  • You may offer multiple license options for the same product (e.g., Standard or Commercial Redistribution)
  • Sellers are responsible for enforcing their chosen license terms against buyers
  • Ensure accurate representation of the license and its restrictions on your product page

Buyer's Responsibility

Buyers are solely responsible for reviewing and adhering to the specific license terms associated with each digital product they purchase.

Definitions & Platform Rules

  • Resale: Selling the asset to another party, whether as-is or slightly modified.
  • Redistribution: Sharing the asset publicly or privately without adding significant value.
  • Sub-licensing: Granting others permission to use the asset as if they were the original licensee.
  • End-product: A project where the asset is used as a supporting component and not the core value (e.g., in a game, design mockup, or course).
  • Main value: Where the asset itself is the primary reason for the end-user to purchase or download the product.
  • Editorial clarity: Modifications made solely to clarify or align with factual or journalistic standards.
  • Commercial templates: Pre-built files or tools designed for resale or widespread use in commercial environments.

These license types are subject to the overall 3dimli Terms of Service and Acceptable Use Policy. In case of conflict, the more specific terms of the chosen product license apply.
